Overview of RICO Crime Charges

The RICO Act (Racketeer Influenced and Corrupt Organizations Act) was enacted into law as part of the Organized Crime Control Act of 1970. It was designed to prosecute members of the Mafia and made it a federal crime to participate in criminal acts on behalf of a criminal organization. The scope of the RICO Act, however, has expanded beyond just organized crime and covers both criminal and civil offenses. Those convicted of being part of an organization that is found guilty of engaging in crimes covered by the RICO Act within the past 10 years can be charged with racketeering, which carries a penalty of up to a $25,000 monetary fine and 20 years in prison on each count.

Multiple crimes can be prosecuted under the RICO Act, including tax evasion, weapons charges, kidnapping, counterfeiting, mail fraud and many others. Beyond the fines and potential jail time, those charged with racketeering can have profits that are considered to have been gained from the illegal activities seized by the government; private citizens who suffered financial loss could also potentially file a civil suit. If you're indicted, the prosecuting attorney can file a pre-trial injunction that prohibits you from transferring property and freezes your assets. They can also require you to put up a performance bond, which guarantees there are assets to be seized should you lose the case.
