Houston Kidnapping Attorney
Have you recently been accused of kidnapping?
Kidnapping is a very emotionally charged offense. People are typically kidnapped for money, revenge against a spouse, or political reasons. While there are many legitimate cases of people getting kidnapped, tragically, there are also cases of innocent people being accused of kidnapping due to a vendetta against them. There are multiple scenarios of people being in the wrong place at the wrong time, getting caught up in a situation out of their control, or simply being involved in a gross misunderstanding.
Kidnapping is legally defined as deliberately abducting another person and restricting their movement and liberty. In some cases, the kidnapping offense is related to a child custody battle or other personal matter that has gotten out of control; other kidnapping allegations could include the threat of deadly force. Kidnapping is a serious felony offense, and in cases in which state borders have been crossed, it is likely to be charged as a federal crime.
In fact, the Texas Penal Code defines this crime as the following;
- A person commits an offense if he intentionally or knowingly abducts another person.
- It is an affirmative defense to prosecution under this section that:
- the abduction was not coupled with intent to use or to threaten to use deadly force;
- the actor was a relative of the person abducted; and
- the actor's sole intent was to assume lawful control of the victim.
- An offense under this section is a felony of the third degree.
