Houston DWI Attorney: Challenging DUI Testing

In almost every DWI arrest process, it is important to realize that the arresting officer will utilize what is known as a DUI testing to determine the level of impairment of the subject. These will range from field sobriety tests to breath and blood tests and even urine tests. Despite the popular myth that a failed DUI test is the final nail in the coffin of a test, the truth is that every test is defensible - and at my firm, I know the steps to take to challenge the evidence.

For example, one of the preliminary tests used in the arrest process is known as field sobriety tests. Over the years, these have gained credibility because the National Highway Traffic Safety Administration has worked to standardize these tests, however, they are still not foolproof. The biggest error known in these tests is the fact that they are purely subjective - they do not have any scientific backing and rather are judge purely on the opinion of the officer. There are many extenuating circumstances and factors that can come into play - causing even a sober person to appear as if they have "failed."

The breath test, on the other hand, is not a subjective test. As a scientific test, the breath test utilized a machine known as the Breathalyzer to analyze a breath sample given by the defendant. This sample will determine the amount of alcohol that the subject has in their system. The main problem with this test is in the training of the officer and the handling of the machine. If the machine is not calibrated properly or is exposed to interfering compounds, it can give a false reading. Also, it is known that the machine has a difficult time differentiating between deep breaths from the lungs and shallow mouth breathing - meaning that any alcohol existing in the mouth can cause a seriously skew the results.

The blood test is often believed to be the most reliable of the tests, however, is not perfect and is known to sometimes cause serious flaws. In these tests, the administration of the test is not usually the aspect that is most often challenged. Rather, it is the handling of the material for the testing. If the draw spot is not sanitized perfectly, if the sample is not stored correctly, if the right amount of anticoagulants and preservatives are not mixed in or if the chain of custody is broken, the results could be wrong.
