What is Child Protective Services looking for?

Texas state law requires that people who believe a child has been abused or neglected make a report to CPS, the Texas Department of Family and Protective Services (DFPS) or to the police. The law also requires that CPS investigate the report. This investigation may include a variety of actions by a caseworker:

  • Recorded (audiotaped or videotaped) interview with the child
  • Visual examination of the child
  • Criminal history check of the alleged abuser
  • Interviews and examinations of all other children in the home
  • Interviews with the alleged abuser and any others who may have information
  • Review of mental health records

The law enforcement agency then determines whether a crime occurred and whether to conduct a criminal investigation. They can bring charges against you and have you arrested for child abuse.
